Definitions
              The Client
: The company or individual requesting the services of Pixel Vision.
              Pixel vision : Primary designer/site owner & employees or affiliates.

    The entire contents of this website is the copyright of Pixel Vision and may not be reproduced without permission. All rights reserved. Any person or company undertaking the services of Pixel Vision agrees to the terms and conditions as set out.
  2. Intellectual Property
    The client will not hold Pixel Vision responsible for any infringement of copyright relating to text contained within designs. It is the responsibility of the client to ensure that no copyright infringement will occur in the use of their company name. Refunds will not be made in cases of such copyright infringement. We always do our best to ensure that our designs are original and do not infringe upon any existing trademarked design. Should this unlikely event occur then the limit of our liability is the price of the package, i.e. the client will be offered a full refund. Pixel Vision reserves the right to reproduce any of its artwork, including approved web sites, for promotional purposes only.
  3. Payment
    Payment must be made within 30 days of invoice. For sites valued at over £2000.00, a deposit of £500.00 will be required prior to commencement of work. For new clients or those overseas Pixel Vision reserves the right to invoice with a payable on receipt of Invoice.
    Please be aware that under the terms of the late Payment of Commercial Debts (Interest) Act 1998, we are entitled to levy interest and a late payment compensation fee on overdue debts. The late Payment Fee is currently levied at £30.00. Please note, non-payment to terms my adversely affect your credit rating.
    Payments will be credited first to late payment charges and next to the unpaid balance. The Client shall be responsible for all collection or legal fees necessitated by late or default in payment. Pixel Vision reserves the right to withhold delivery and any transfer of ownership of any current work if accounts are not current or overdue invoices are not paid in full. All grants of any license to use or transfer of ownership of any intellectual property rights under this Agreement are conditioned upon receipt of payment in full which shall be inclusive of any and all outstanding Additional Costs, Taxes, Expenses and Fees, Charges or the costs of Changes.
  4. Design Process
    Clients may request any number of revisions providing they give clear and concise feedback during the design phase. Once the design has been signed off and deemed complete, any amendments could be subject a charge.
  5. Website Approval
    The design process will terminate when the client gives final written approval of a website. All liabilities for errors, changes, or alterations become the responsibility of the client, once a design has been approved. On completion of the design process, and payment in full, the ownership and copyright of the final website is automatically transferred to the client.
  6. Privacy
    While building your website Pixel Vision may need access to personal or sensitive information. Under no circumstances will this information be given or sold to a third party. Your e-mail address will not be used to contact you regarding matters not related to the design and build of your website nor will it ever be given or sold to or otherwise shared with others.
  7. Database, Application and E-Commerce Development
    Pixel vision cannot take responsibility for any losses incurred by the use of any software created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use. Any scripts, cgi applications or software (unless specifically agreed) written by Pixel Vision remain the copyright of Pixel vision and may only be commercially reproduced or resold with the permission of Pixel vision. Where applications or sites are developed on servers not recommended by Pixel vision, the client is expected to provide or seek any information, additional software, support or co-operation pertaining to the server required in order for the application to be correctly developed. It is the clients responsibility to provide a suitable testing environment which is identical to the final production environment. The client is expected to test fully any application or programming relating to a site developed by Pixel vision before being made generally available for use. Where "bugs", errors or other issues are found after the site is live, Pixel vision will endeavour (but is not obliged to) to correct these issues to meet the standards of function outlined in the brief.
  8. Website Hosting No guarantees can be made as to the availability or interruption of this service and Pixel vision cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss. Pixel Vision reserve the right to refuse to handle in any way, material which may be deemed offensive, illegal or in any way controversial, and also to terminate the free hosting service should the necessity arise.
